1. Acceptance of Terms
By accessing, registering for, or using POV CRM, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you must discontinue use of the platform immediately.
These terms govern all users, subscribers, clients, and visitors of the POV CRM platform, including all services, features, tools, applications, mobile access, and integrations.

2. Description of Services
POV CRM provides business management, client relationship management, marketing automation, sales pipelines, form creation, email/SMS broadcasting, scheduling, funnel building, and various business tools.
We reserve the right to modify, add, or remove features at any time without notice.

3. User Eligibility

To use POV CRM, you must:

Be at least 18 years old
Have the legal capacity to enter into a binding contract
Provide accurate and truthful information during registration
Use the platform only for lawful business purposes

We may refuse service or terminate accounts at our discretion.

4. Account Registration & Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity under your account
Immediately notifying us of any unauthorized access

We are not responsible for losses arising from unauthorized use of your account.

5. Subscription Billing & Payments

A. Billing

POV CRM operates on subscription-based billing.
By subscribing, you authorize us (and our payment processors) to charge your selected payment method.

B. Renewal

Subscriptions renew automatically unless canceled before the renewal date.

C. Refunds

All payments are non-refundable, including:

Monthly/annual subscriptions
Add-on services
Setup fees
SMS/Email usage credits
Training or onboarding sessions

Exceptions may be made at our sole discretion.

D. Failed Payments

If your payment fails:

Your account may be suspended
Late fees or service interruptions may occur
Data and access may be permanently deleted after extended non-payment

6. Acceptable Use Policy

Users agree not to use the platform to:

Send spam, bulk unsolicited messages, or misleading communications
Upload or distribute viruses, malware, or harmful software
Violate copyright or intellectual property rights
Conduct fraud, scams, or deceptive practices
Violate any laws or regulations (CAN-SPAM, TCPA, GDPR, etc.)
Harass, threaten, or harm others
Attempt to access other users’ accounts or data

Violations may lead to immediate termination without refund.

7. Email, SMS & Communication Compliance

Users must comply with all applicable communication laws, including:

CAN-SPAM Act (USA)
TCPA (Telephone Consumer Protection Act)
GDPR (if operating in or marketing to EU users)
Carrier/telecom anti-spam regulations

You are responsible for:

Obtaining proper consent
Managing opt-ins/opt-outs
Ensuring legal compliance for all messages sent through POV CRM

We reserve the right to suspend messaging privileges at any time for violations.

8. Integrations and Third-Party Services

POV CRM provides integrations with third-party tools such as:

Google
Facebook/Instagram
Stripe
Email/SMS providers
Calendar and communication apps

We are not responsible for:

Their reliability
Their policies
Data transferred through these integrations

You authorize data sharing between integrated apps and POV CRM.

9. Data Ownership

Your Data

You retain ownership of all data you upload, including:

Contacts
Business information
Files
Forms
Campaign data

Our Rights

By using POV CRM, you grant us permission to:

Host and store your data
Process it for CRM functionality
Use anonymized, aggregated data to improve system performance

We do not sell user data.

10. Intellectual Property

All content and technology within POV CRM—including logos, designs, software, databases, analytics, documentation, and training—are owned by Point of View Consulting Inc.

You may not:

Copy
Reverse-engineer
Resell
Clone
Reproduce
Modify
Distribute
any part of the platform without written permission.

11. Termination of Service

We may suspend or terminate your account immediately if:

You violate these Terms
You engage in illegal or unethical activity
Your payment fails or remains overdue
You misuse communication tools (email, SMS)
We detect security risks or suspicious activity

Upon termination:

You lose access to the platform
Your data may be permanently deleted
No refunds will be issued

You may cancel at any time through your account or by emailing us.

12. Disclaimer of Warranties

POV CRM is provided “as is” and “as available” without warranties of any kind including:

Merchantability
Fitness for a particular purpose
Accuracy
Availability
Reliability

We do not guarantee:

Results or business performance
Uptime or error-free operation
Success of marketing campaigns
Delivery of emails or SMS messages

13. Limitation of Liability

To the fullest extent permitted by law, POV CRM and Point of View Consulting Inc. are not liable for:

Loss of business, revenue, or profits
Loss of data
Downtime or service interruptions
Misuse of your account by a third party
Integration errors
User errors or non-compliance issues
Indirect, special, or consequential damages

Our total liability shall not exceed the amount you paid in the last 12 months.

14. Indemnification

You agree to indemnify and hold harmless POV CRM, Point of View Consulting Inc., and all related parties from:

Claims
Damages
Losses
Fines
Attorney fees

arising from your use of the platform, violations, or third-party claims based on your data or communications.

15. Changes to Terms

We may update or modify these Terms at any time. Updates become effective upon posting to this page. Continued use of the platform indicates acceptance.
